Refund & Cancellation Policy

1. Introduction
This Refund & Cancellation Policy ("Policy") explains the rules governing refunds, cancellations, membership payments, online purchases, digital products, subscriptions, seminars, events, merchandise, and related services offered by Shackelford's Mixed Martial Arts Center Inc. ("Shackelford's MMA," "we," "our," or "us").
This Policy should be read together with our Terms & Conditions, Privacy Policy, membership agreements, waivers, and any other written agreements applicable to your purchase.
If a separate written agreement contains different refund or cancellation terms, that agreement will control for the services covered by it.
2. Membership Agreements
Memberships are governed primarily by the individual membership agreement signed by the member or the member's parent or legal guardian.
Unless otherwise stated in a signed agreement:
- Membership fees are due according to the selected billing schedule.
- Members remain responsible for payments due before a cancellation becomes effective.
- Membership obligations are not automatically suspended because of non-attendance.
Failure to attend classes does not automatically cancel a membership.
3. Membership Cancellations
Members may request cancellation in accordance with the terms of their signed membership agreement.
Cancellation requests should be submitted using the method specified in the applicable membership agreement or by contacting our business.
Cancellation requests are not considered effective until they have been received and processed.
Any required notice period stated in the membership agreement will apply.
4. Trial Programs and Introductory Offers
Free classes, introductory programs, promotional offers, and trial memberships may be modified, suspended, or discontinued at any time.
Unless expressly stated otherwise in writing:
- Promotional offers have no cash value.
- Promotional offers may not be combined with other offers.
- Promotional offers may be limited to first-time participants.
- Promotional offers are subject to availability.
5. Online Purchases
We may offer products and services including:
- Merchandise;
- Gift cards;
- Digital memberships;
- Online subscriptions;
- Instructional videos;
- Downloadable materials;
- Seminars;
- Camps;
- Private lessons;
- Events;
- Other products or services.
Refund eligibility varies depending upon the type of purchase.
6. Digital Products and Online Memberships
Because digital products, online courses, downloadable materials, streaming content, and subscription services become accessible immediately upon purchase, all sales of digital products are generally final unless otherwise required by applicable law or expressly stated in writing.
If we determine that a technical issue prevented you from receiving purchased digital access, we may, at our discretion:
- Restore access;
- Replace the product;
- Provide another reasonable remedy;
- Issue a refund where appropriate.
7. Merchandise
Unused merchandise may be eligible for return or exchange within the timeframe designated by our business, provided that it is:
- In new condition;
- Unused;
- Unworn;
- Returned with original packaging where applicable.
The following items generally are not eligible for return unless required by law:
- Customized products;
- Clearance items marked "Final Sale";
- Gift cards;
- Downloadable products;
- Opened personal-use items where resale would not be appropriate.
Customers are responsible for return shipping costs unless the return results from our error or a defective product.
8. Seminars, Camps, Events, and Private Lessons
Registration fees for seminars, camps, competitions, private lessons, or special events may be subject to separate cancellation deadlines.
Unless otherwise stated:
- We may issue refunds, credits, or transfers at our sole discretion.
- Missed events generally do not qualify for refunds.
- We reserve the right to cancel or reschedule events due to instructor availability, low enrollment, facility issues, severe weather, emergencies, or other circumstances beyond our reasonable control.
If we cancel an event, we may provide a refund, credit, or transfer to another event.
9. Failed Payments
If a scheduled payment is declined, returned, or otherwise unsuccessful, we reserve the right to:
- Retry the payment;
- Request another payment method;
- Suspend services until payment is received;
- Assess any fees permitted by applicable law or contract;
- Pursue collection of amounts lawfully owed.
10. Chargebacks and Payment Disputes
If you believe a billing error has occurred, we encourage you to contact us before initiating a chargeback with your financial institution.
Initiating a chargeback does not automatically relieve a customer of contractual payment obligations.
Where permitted by law, we reserve the right to contest fraudulent or improper chargebacks and to pursue any contractual remedies available.
11. Refund Method
Approved refunds will generally be issued using the original method of payment whenever reasonably possible.
If that method is unavailable, we may issue a refund by another reasonable method, store credit, or account credit, where permitted by law.
Refund processing times depend on financial institutions and payment processors and may take several business days after approval.
12. Exceptional Circumstances
From time to time, we may approve refunds, credits, extensions, freezes, or other accommodations outside this Policy due to extraordinary circumstances.
Such accommodations are made on a case-by-case basis and do not create a continuing obligation to provide similar accommodations in future situations.
13. Fraud Prevention
We reserve the right to refuse refunds, deny cancellations, suspend services, or investigate transactions where we reasonably suspect:
- Fraud;
- Identity theft;
- Unauthorized payment methods;
- Abuse of promotional offers;
- Misrepresentation;
- Other unlawful activity.
14. Business Closures and Service Interruptions
If classes, programs, websites, digital services, or facilities are temporarily unavailable due to circumstances beyond our reasonable control, we may provide reasonable alternatives where appropriate, including:
- Makeup classes;
- Online access;
- Account credits;
- Schedule adjustments;
- Other accommodations at our discretion.
Nothing in this Policy guarantees any particular remedy unless required by applicable law or a separate written agreement.
15. Policy Changes
We reserve the right to modify this Refund & Cancellation Policy at any time.
Changes become effective upon posting unless otherwise required by law.
The version in effect at the time of your purchase or as otherwise required by applicable law will govern your transaction.
